Terms of Service

These Terms of Service ("Terms") govern your use of the ContractorPass platform operated by Mighty Advancement ("we", "us", "our"). By creating an account, you agree to these Terms.

1. Service Description

ContractorPass is a compliance management platform that helps Dubai contractors track regulatory obligations under Dubai Law No. 7 of 2025, including:

  • Dubai Municipality registration and classification tracking
  • Staff Professional Competency Certificate (PCC) monitoring
  • Subcontractor approval status tracking
  • Expiry alerts and compliance score calculation
  • Optional document storage

2. Account Registration

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the security of your account credentials
  • Each account represents one contracting company; you may not share accounts across separate legal entities
  • You must be authorised to act on behalf of the company you register

3. Acceptable Use

You agree to:

  • Use the platform only for lawful compliance management purposes
  • Not upload malicious files, harmful content, or data you do not have the right to store
  • Not attempt to access other users' data or exploit the platform's security
  • Not resell, redistribute, or sublicence access to the platform

4. Subscription and Payment

  • Free trial: New accounts receive a 14-day free trial with full access
  • Billing: After the trial, you will be billed monthly or annually based on your selected plan
  • Prices: All prices are in AED and exclude VAT unless stated otherwise
  • Annual discount: Annual prepayment includes 2 months free (~17% discount)
  • Upgrades/downgrades: You can change your plan at any time; changes take effect at the next billing cycle
  • Refunds: Monthly plans are non-refundable. Annual plans may be refunded pro-rata within the first 30 days

5. Plan Limits

Each plan has specific limits on staff members, subcontractors, and storage. If you exceed your plan limits, you will need to upgrade to continue adding records. Existing data will not be deleted if you downgrade, but you will not be able to add new records until you are within limits.

6. Data Ownership

  • Your data is yours. We do not claim ownership of any data you enter into ContractorPass
  • You can export all your data at any time in standard formats
  • We use your data solely to provide the service as described in our Privacy Policy

7. Service Availability

  • We target 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be communicated at least 48 hours in advance
  • We are not liable for downtime caused by factors beyond our control (internet outages, Azure platform issues, force majeure)

8. Disclaimer

ContractorPass is a compliance tracking tool, not legal advice. While we help you track deadlines and obligations under Dubai Law No. 7 of 2025:

  • We do not guarantee regulatory compliance — you are responsible for ensuring your company meets all legal requirements
  • Compliance scores are indicative and based on data you provide; they do not constitute a legal assessment
  • We recommend consulting with qualified legal professionals for compliance decisions

9. Limitation of Liability

To the maximum extent permitted by UAE law:

  • Our total liability for any claim arising from these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages including lost profits, fines, or penalties imposed by regulatory authorities

10. Account Termination

  • By you: You can cancel your account at any time. Your data will remain accessible until the end of your billing period, after which it will be deleted per our retention policy
  • By us: We may suspend or terminate accounts that violate these Terms, with notice where practical

11. Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes shall be resolved in the courts of Dubai, UAE.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the platform after changes take effect constitutes acceptance.
